As an employer, am I required to withhold Wilmington income tax from employees’ pay?
A resident employer or an employer having employees working within the City must withhold Wilmington income tax (1.5%) from all salaries, wages, commissions, bonuses, or other compensation paid to employees before any deductions. This is applicable for a business whose primary office is outside of the city limits, as well as those in the City.
How are net operating losses treated?
A Corporation or Partnership may carry forward the loss and can offset it against its future income for up to five years. Net operating losses cannot be used to offset wages.

The Moyer Community Room is available for rental to the public on a first come, first serve basis. The City reserves the right to cancel any reservations when they conflict with City business.
Additional Details
The room contains approximately ten (10) 60-inch round tables and approximately ten (10) 8-foot rectangle tables and approximately 140 chairs. The room also houses a standard refrigerator with freezer. There is a sink but there is no stove or microwave. The room capacity is 167 people. The dimensions of the community room are 44 x 45 x 41 feet.
Guidelines
The following are prohibited:
Taping or tacking items to the community room walls.
The use of candles or open flames (this does not include chafing dishes used for catering.)
The use of tobacco and alcohol are prohibited.
The possession of firearms.
Pets or animals (with the exception of assistance animals).
Yard Sale Permit
Wilmington city ordinance requires a permit for any and all “home sales” which is defined as the sale of ten or more items of tangible personal property within any residential zoning district. Residents are limited to two home sales per year, which may last up to three consecutive days between the hours of 7:00 am and 7:00 pm.

This permit is required for any opening or use of the public right of way. Examples: Utility work, sidewalk/driveway installation or repair, closure of alley, parking space, or lane(s) of traffic.

An event permit is required for events taking place on public property, and event-related road closures/lane restrictions. Public park rentals and mobile stage rentals should be applied for separately. Examples: Block parties, street fairs, parades, organized runs/walks.

Why does the City perform hydrant flushing?
Hydrant flushing is the quick release of water from fire hydrants. It’s a controlled procedure that
is vital to the general maintenance of the City’s water distribution system. It ensures adequate
water flow is available to fire fighters, residents and businesses. It also improves water quality by
clearing iron and other mineral deposits from the water mains.
What are the effects of hydrant flushing?
Hydrant flushing helps ensure water quality and helps avoid random bouts of rusty water if there
is a high demand for water, caused by a major firefighting effort or water main break.
During the flushing of a hydrant, some customers may notice reduced water pressure and flow.

Does the City test the water regularly? Is the testing done at various sites?
The City of Wilmington tests the water both leaving the water plant and throughout the water
system regularly, following U.S. and Ohio Environment Protection Agency protocols. Many
tests are also completed around the clock during the water treatment process.
I live on the west side and the City is flushing hydrants on the east side. How come my water is discolored?
Sometimes residents who live beyond the limits of the area where hydrant flushing is currently
being performed, may notice rust-colored water. This can occur because the opening of a hydrant
can cause water run in the opposite direction than normal. Water Department personnel use
techniques intended to minimize these impacts.
How come my water is discolored, but my neighbor didn’t notice any discoloration?
If the water inside a home or business is turned on while hydrant flushing going on, discolored
water may enter your plumbing. If a neighbor did not use water during day, they most likely will
not notice any discoloration.
My water is discolored. What should I do?
Wait until flushing has subsided in your area then run a cold water tap until the water runs clear.
Remember rust colored water is safe, but it may stain laundry. If this happens, keep clothes wet
and treat them with stain remover.
If you notice the water flushing crew is near your property, refrain from using water, and delay
washing clothes as much as possible
How often is hydrant flushing done?
Hydrant flushing is performed two times a year—once in the spring and once in the fall. The
work is generally done between 8 am and 2 pm.

Furniture/Matresses
The City of Wilmington will collect mattresses, box springs, and upholstered furniture as part of bulk pick up. These items must be wrapped in plastic and sealed.
The City of Wilmington maintains an Ohio EPA regulated Class IV composting site for use by Wilmington residents. Residents may bring yard waste loads containing no other trash or debris to our facility.
As part of its service, the City will, also collect roadside;

- grass clippings
- weeds
These itemsmust be placed in paper yard waste bags which are purchased from the City of Wilmington.
The bags are $2.00 each and can only be purchased at the following locations;

City Landfill – 397 S. Nelson Avenue
The City will not pick up any other type of bag from any other retailer.
Brush
- Small amounts of brush will be picked up as part of the regular yard waste collection service, at no extra charge.
- Brush and limbs must be cut in no longer than 4′ lengths and bundled tightly with twine. Bundles must be easy for one person to lift and throw into a dump truck.
- It is not the intent of the service to provide for removal of entire trees.
Carpet
Carpet collected at curbside must be;
- Cut and rolled into no longer than 4’ lengths
- Be no more than 10” in diameter,
- Wrapped in plastic
- Tied with twine
- Sized so one person is able to lift into a dump truck
The collection of up to 10 rolls of carpet will be considered one (1) bulk item.
Reinspection
If the work to be inspected is not completed or ready at the requested date or by the arrival of the inspector or the building does not comply with the code and another inspection is required, then a reinspection fee of $200.00 may be assessed. This must be paid prior to the reinspection or any further inspections.
Christmas Trees
Christmas trees will be collected at no charge when placed in your normal trash location area. Weather permitting, this is normally done during the first two weeks of January.
Final Inspection
Made after all exterior and interior work is completed, including electric and HVAC, and building is ready for use and occupancy.
Other Inspections
In addition to the called inspections above, the Building Official may make or require any other inspections or special inspections to ascertain compliance with Codes and other requirements enforced by the Building Official.
Final Electrical/Mechanical
Made after fixtures and devices are in place, HVAC installation is completed, and everything is operational.
Drywall
Made after all drywall is hung, but before it is taped or finished.
Rough Framing/Masonary
Made after roof, masonry, all framing, fire stopping, draft-stopping, and bracing are in place, and previous inspections are completed.
Insulation/Vapor Barrier
Made after insulation and vapor barrier are installed. If you are installing blown-in insulation in the attic, it will be inspected with structural final inspection.
Rough Electrical/Mechanical
Made prior to covering or concealment, all boxes and wiring completed, grounding in boxes completed, ductwork completed and prior to or along with framing inspection.
Foundations/Slab
Made after excavation, forms, gravel, required mesh, rebar, plumbing, and vapor barrier are in place. Perimeter drains, damp-proofing or waterproofing shall be completed and inspected prior to backfilling.
Footer
Made after excavation is completed and crumbed out, forms are set, or footer is staked, and any rebar required is placed. Lot line markers will also be checked.
Why do I need a building permit?
Building permits and inspections basically protect the consumer from unscrupulous contractors who may not build to the codes. They also help the do-it-yourself homeowner, who may not have a working knowledge of building codes, ensure that their building projects are completed safely and in accordance with current building codes.
When do I need a permit?
A permit is required for the erection, repair, alteration, improvement, and addition of or to any building within the City. Permits are not required for ordinary maintenance or repair, unless the alteration changes the exterior lines or limits of the building, changes the number of living units within the building, or relates to the sanitary condition, which requires a building permit regardless of the cost of the improvement. Replacement windows do not require a permit. We do require a permit to put siding on your house.
Do I need a permit for a swimming pool?
Yes. Check the zoning requirements for your district to ensure you have an area large enough to provide the required setbacks from the property lines, that you are not exceeding the number of accessory structures allowed, and that you meet safety requirements listed as well.

What if we live outside the city limits of Wilmington?
Building permits and zoning issues outside of the city limits are under the jurisdiction of the Clinton County Building & Zoning Department. They are located at 111 S. Nelson Avenue, and their phone number is (937) 383-2054.
Do I have to go to Columbus to get a State Permit for a commercial building?
No. The City of Wilmington Building Department became a State of Ohio Certified Building Department in 1991, which enables us to issue commercial building permits and perform all inspections for those permits, except plumbing, which is handled through the Clinton County Health Department.
Does the City of Wilmington issue permits for construction of manufactured homes?
Manufactured homes must go through a third party for permitting and inspections. Please contact the Ohio Manufactured Homes Commission Website at or by phone at 614-466-4100 for more information. If you are planning on constructing a mobile/manufactured home within the City limits, you will need to contact our office for zoning approval. Manufactured homes must be located within areas zoned ‘Manufactured Home Park District’.

What is zoning?
Zoning refers to legislation that basically maintains the integrity of the neighborhood, whether residential or commercial. An extreme example of the benefits of zoning would be as follows: Zoning legislation would stop your neighbor from operating a landfill next to your home located in a nice quiet subdivision. By maintaining the integrity of the neighborhood, zoning protects your property value and enables you to enjoy your home, without excessive noise from traffic or industry right next door.
Do I need a zoning permit?
Yes. Zoning and building permits are two different approvals. Zoning permits are required for new construction, structural alterations that change the exterior limits of the structure footprint, changes to the number of units in a building, and new business occupancies and uses.The entire Zoning Code can be viewed via a link at the bottom of this page. Sign permit applications are reviewed for both zoning and building requirements concurrently.
Do I need a permit to put up a fence around my home?
Yes. Zoning regulations allow fencing up to 7′ tall to be located in any side or rear yards. Fencing located in the front yard is restricted to a height of 4′ tall and must be of an ornamental design. There is no minimum setback from the property line for fencing. If you need to have your property lines marked, you will need to contact a surveyor.

What is Site Plan Review?
Site plan review is required for all commercial projects that include any changes to the site or changes of use and other projects as listed in Article II of the zoning code. During the site plan review, projects are reviewed to ensure that they meet zoning and development requirements such as stormwater drainage, the number of parking spaces, landscaping, lighting, etc.

Water and Sewer charges are based on usage. Refuse, or trash collection, is a flat rate of $21.93 per month for residential customers, effective January 1, 2024. This includes the use of one city provided refuse toter and one city provided recycling toter. Additional city refuse toters are provided at an additional monthly cost of $6.68 per toter.
I am starting a new business, what permits do I need from the Building Department?
New businesses require, at a minimum, a Certificate of Use and Occupancy. To apply for this, the applicant must fill out a Commercial Permit Application, provide a floor plan of the space with dimensions, uses of rooms listed, the main points of egress, and pay the applicable fee. After an inspection by the Building, Zoning, and Fire Departments, a Certificate of Use and Occupancy can be issued. If there is a change of use for an existing building, the floor plans will be required to be stamped by an engineer or architect. If the new business is already obtaining building permits for work to be performed, the Certificate of Occupancy will be included (no separate application or fee needed). Separate permits will be required for signage. If your business is located within the Downtown Historic zone, additional approvals are required for any changes made to the exterior of a building (outside of ordinary maintenance and repair).
